Standard Operating Procedures
Buyers
Effective April 19, 2022
Under New York law, real estate brokerages must post the procedures they require of prospective buyers. These are Marshall Realty & Associates' procedures:
- Identification. It is not required for any prospective customer of Marshall Realty & Associates to furnish identification prior to entering a customer relationship with Marshall Realty & Associates or its Agents.
- Buyer agreements. An exclusive “Right to Buy” or “Buyer Broker’s Agreement” may be offered at each individual Agent’s discretion, but customers are not required to sign such Agreement as a pre-requisite for doing business with Marshall Realty & Associates.
- Mortgage pre-approval. While getting “pre-approved” for a mortgage is advantageous to the Buyer, it is at the discretion of each Agent as to whether they choose to work with a customer who has not been “pre-approved” for a mortgage. It is the position of Marshall Realty & Associates, that prospective customers are not required to be pre-approved for a mortgage as a pre-requisite for doing business with Marshall Realty & Associates.
